Terms and Conditions of Use
By using this website you agree to abide by these Terms and Conditions.
The Heart Foundation may, without notice, amend or modify its Terms and Conditions by posting the amended Terms and Conditions to this website.
If any of these Terms and Conditions are found to be invalid or unenforceable, the invalidity or unenforceability of a particular Term or Condition will not affect the remainder of the Terms and Conditions, which will continue in full force and effect.
Heart Foundation Learning Hub (Moodle)
The Heart Foundation’s Learning Hub (Learning Hub) is delivered using Moodle® software provided by third party service providers (including Moodle Pty Ltd (ABN 55 116 513 636 and My Learning Space ABN 45 536 763 230, and other implementation/support partners). It provides access to digital educational courses and related materials. References to “Website” in these Terms & Conditions include the Learning Hub unless the context requires otherwise.
By creating an account or using the Learning Hub, you agree to these Terms & Conditions and to any additional Learning Hubspecific notices referenced in these Terms (including our Privacy Policy). Where use of the Learning Hub involves thirdparty platforms or service providers, you must also comply with any terms that apply to those services to the extent they apply to you. Please read them carefully.
If you do not agree to these terms, do not use the Learning Hub.
Who can use the Learning Hub
Access is available to individuals aged 18 years or over who register for an account. When you register, you warrant that:
- you will provide accurate and up‑to‑date information.
- you understand the information contained on the Learning Hub is for educational purposes only and does not substitute professional medical advice.
- you acknowledge and understand that healthcare professionals are still to make appropriate decisions based on the individual circumstances of each person and nothing in the Learning Hub constitutes personalised medical advice.
- you will keep your login credentials secure and confidential and will not share your account; and
- you will promptly notify us if you suspect unauthorised access or use of your account.
Each account is for individual use only and you are responsible for all activity that occurs under your account.
We may deactivate and subsequently delete accounts that have been inactive for 12 months. Where practicable, we will give at least 14 days’ notice to your registered email before deletion. You are responsible for exporting any records you wish to retain (for example, certificates) prior to deletion. We may retain personal information as required by law and in accordance with our Privacy Policy (including in de-identified form for reporting and evaluation).
Users are responsible for backing up any materials they upload or are required to retain, where permitted under this Terms and any applicable licences.
We may suspend or terminate access (with or without notice) if we reasonably consider that your use:
- breaches these Terms & Conditions.
- is unlawful, poses a security risk, or misuses the Learning Hub; or
- adversely affects other users or our systems.
If your account is suspended or terminated, your right to access the Learning Hub ends immediately. Any further use of Learning Hub materials must comply with the Intellectual property section of these Terms (including any Creative Commons licence stated for specific materials).
If you believe your account has been suspended or removed in error, you may contact learninghub@heartfoundation.org.au to request a review.
International Users
This Learning Hub has been developed in accordance with Australian law and based on Australian clinical evidence and guidelines. If you access the Learning Hub from outside Australia, you do so at your own risk and are responsible for ensuring that your use complies with the laws of your country of residence. The Heart Foundation does not warrant that the Learning Hub or its Content complies with the laws of any jurisdiction outside Australia. Where personal information is provided by international users, it will be handled in accordance with our Privacy Policy and the Australian Privacy Principles.
User conduct
You must not (and must not attempt to): circumvent security or access controls; copy, host, frame, scrape, index or harvest Learning Hub content other than as permitted by these Terms; upload malicious code; infringe intellectual property or privacy rights; or use the Learning Hub for unlawful, commercial or advertising purposes. (See also Restrictions on use and Intellectual property.)
You must not forge, alter, obscure, reproduce, misrepresent, or otherwise tamper with any certificates, digital badges, completion records, or other credentials generated by the Learning Hub. Any such conduct is strictly prohibited and may result in immediate account termination and referral for further action where appropriate.
Moodle features and availability
Access to Learning Hub courses is provided at no charge unless we clearly state otherwise at the point of enrolment. Courses are generally selfpaced and may include progresstracking features. Usertouser messaging, forums, chat and comments are disabled.
We may modify, suspend or withdraw courses, features or services at any time. Availability is not guaranteed and we do not warrant that any particular course will remain available. (See Indemnity, disclaimer and limitation of liability.)
Cookies
An essential session cookie (typically “MoodleSession”) is required to keep you logged in and is deleted when you log out or close your browser. An optional convenience cookie (typically “MOODLEID”) remembers your username. You can refuse this cookie, resulting in the need to re-enter your username on each visit. Further information is set out in our Privacy Policy.
Learning Hub Content and Intellectual Property
The Learning Hub provides access to web pages, documents, software, services, images, graphics, data, formulas, audio and video, and other materials (Content). Unless stated to the contrary, Content is owned by or licensed to the National Heart Foundation of Australia (ABN 98 008 419 761). (See Intellectual property.)
Some Learning Hub modules may be developed in collaboration with universities, research partners or other thirdparty institutions. Ownership, licensing and attribution requirements for these modules will be stated on the relevant module or Content page. Where no licence or attribution is specified, all rights in such content are reserved to the Heart Foundation or the relevant thirdparty owner (as applicable).
Except as expressly stated for particular materials, Heart Foundation Content is licensed under the Creative Commons Attribution – NonCommercial – No Derivative Works (CC BYNCND) 4.0 licence, as described in the Intellectual property section (including attribution requirements). Where different licence terms are stated for specific Content, those terms prevail for that Content. Always check the licence terms stated on the relevant course or Content page before downloading or reusing Content.
Where attribution is required, the course or Content page will identify the Heart Foundation and/or any authors to be credited and the form of attribution required. Some Content includes or links to thirdparty materials which remain the property of their respective owners and may be subject to different licence terms. Where stated, follow the licence terms identified for those materials. Otherwise, you must verify the terms directly with the owner. (See Hyperlinks, advertising, sponsors and ThirdParty Content.)
Privacy Specific to the Learning Hub
When you register, we collect personal information such as your name, email address, postcode and role/occupation (e.g. clinician, nurse, academic student). We use this information to create and administer your account, deliver courses and track completion, improve the Learning Hub, and support evaluation and reporting.
We may share deidentified or aggregated information (for example, user counts by profession or role/occupation) with internal teams, funding bodies, licensees and institutions that support or cocreate content, and we may publish aggregate insights publicly. We do not disclose personally identifiable information in these outputs.
Access to identifiable Learning Hub data is restricted to authorised Heart Foundation personnel and our contracted service providers (for example, hosting and learning management support providers) for the purposes described above.
Personal information is handled in accordance with our Privacy Policy and the Australian Privacy Principles. Where third party service providers process personal information on our behalf, they do so under contract and subject to privacy and security obligations. You may be offered the option to receive marketing and promotional communications (for example, newsletters). If you opt in to receive these communications, you may withdraw your consent at any time using the “unsubscribe” link included in those communications or by contacting contactus@heartfoundation.org.au. Unsubscribing from marketing communications will not affect the delivery of essential service emails relating to your Learning Hub account (such as password resets, enrolment confirmations or system notifications).
Disclaimers Specific to the Learning Hub
Learning Hub Content is provided for information and educational purposes only and is not a substitute for professional medical advice, diagnosis or treatment. The Heart Foundation provides no warranty or guarantee that the information on the Learning Hub is suitable for any specific purpose or that it meets the needs of every user. Users are responsible for reviewing and assessing the accuracy, currency, reliability, relevance and completeness of the information contained on the Learning Hub. Healthcare professionals are still to make appropriate decisions based on the individual circumstances of each person. Healthcare professionals remain responsible for verifying current regulations and recommendations before applying any treatments or interventions referred to in any Learning Hub content. The Heart Foundation does not provide personalised medical advice through the Learning Hub. (See Restrictions on use and Indemnity, disclaimer and limitation of liability.)
Content may become out of date and may be superseded by changes in legislation, policy or practice. You are responsible for ensuring your knowledge remains current.
Your use of the Learning Hub is subject to the Indemnity, disclaimer and limitation of liability section of these Terms. Without limiting that section and to the extent permitted by law, we do not guarantee that the Learning Hub or its Content will be errorfree, secure or continuously available.
Content and courses may link to external websites or services. We are not responsible for, and do not endorse, thirdparty content. Your use of external sites is at your own risk. (See Hyperlinks, advertising, sponsors and ThirdParty Content.)
Certain Learning Hub materials may incorporate or be informed by generative or automated content development technologies. All final educational materials are reviewed by the Heart Foundation before publication. However, automated processes may introduce errors or omissions. You are responsible for exercising your own judgement and ensuring that your understanding remains current.
